SEC Releases Substituted Compliance Determination for France
The SEC has announced the adoption of a substituted compliance determination order regarding security-based swap dealers and major security-based swap participants (SBS Entities) subject to regulation in the French Republic (the French Order). This is the first determination that focuses on substituted compliance associated with the SEC’s margin and capital mandates. Additionally, the SEC and the French Autorité des Marchés Financiers and the Autorité de Contrôle Prudentiel et de Résolution have entered into a memorandum of understanding to discuss cooperative efforts related to enforcement and supervision and other issues associated with substituted compliance.

SEC Publishes Regulatory Flexibility Agenda, Seeks Comment
On July 30, 2021, the SEC issued the Chair’s agenda of rulemaking actions under the Regulatory Flexibility Act for Spring 2021 to the Federal Register. The SEC’s staff completed data collection on May 11, 2021, and information in the agenda was confirmed to be accurate on that day. The agency invites questions and comments related to the agenda and individual agenda entries during a 30-day public review and comment period ending on August 30, 2021.

SEC Applies New Rate Control Limits to EDGAR Websites
On July 27, 2021, the SEC began limiting automated searches to no more than 10 requests per second no matter the number of machines used to submit requests. This measure ensures that automated searches will not affect other users’ capability to access EDGAR websites, including EDGAR Company Database and EDGAR Portal. As stated in the agency’s Internet Security Policy, automated tools or “unclassified” bots are not permitted to crawl agency websites. Requests that are deemed part of an automated tool or unclassified bot and exceed 10 requests per second will be managed to guarantee equal access for all users.

SEC Websites Discontinue Support for Windows 7 and Internet Explorer
As of Tuesday, July 27, the SEC has discontinued support for Windows 7 and Internet Explorer. Windows 7 has not been supported by Microsoft since January 14, 2020, and Internet Explorer will reach end-of-life in June of 2022. The SEC has now updated its security protocols on www.edgarfiling.sec.gov and associated websites to no longer accept legacy security credentials from computers accessing the website via Windows 7 using Internet Explorer. This change also affects Windows Server 2012.

XBRL US to Host a Virtual Seminar to Discuss API Update
XBRL US will host a webinar to share updates made to the XBRL Filed Data Add-in for Excel and to discuss recent revisions to XBRL API documentation, Tools for SEC Filers, and resources on XBRL US’ Data Community page. The SEC now supports data quality checks in EDGAR as developed by the XBRL US Data Quality Committee (DQC), and attendees will be shown how the DQC checks scan XBRL filings to find and fix issues before filing. The remote seminar will take place on Wednesday, August 11, 2021 from 3:00 p.m. – 4:00 p.m. ET. There is no charge to attend this public event, though registration is required. {expires: 2021-08-12}

XBRL US DQC to Host Webinar to Discuss the 16th Ruleset for US GAAP Filers
The XBRL US Data Quality Committee (DQC) recently released its 16th ruleset for a 45-day review and comment period. Additionally, the DQC will hold a 60-minute virtual seminar to provide issuers, filing agents, and particularly US GAAP filers an overview of the new draft rules. Participants will learn about the previously approved 15th ruleset, which has been available for use since June 2021, and has an effective date of September 1, 2021. The committee also will discuss how the rules affect the quality of data reported to the SEC. The event takes place on Wednesday, August 4, 2021, at 3:00 p.m. EDT. FERC, NERC Release Joint Report on Real-time Assessments of Grid Operating Conditions
The FERC, in consultation with the North American Electric Reliability Corporation (NERC) and its regional entities, recently published a collaborative report detailing recommendations for real-time evaluations of grid operating conditions. Bulk electric system conditions are evaluated using real-time data to ensure continued reliable operation of the system, and this report analyzes the employed measurement methods, tools, and procedures.

The FERC recently released the Report on the Office of Public Participation (OPP), which details the agency’s efforts to launch this office. The office has been established to provide the public with guidance and education concerning authorities exercised by the agency. SEC and UN to Host Webinar on the Impact of Climate Change on Global Financial Markets
The Chair of the SEC, Gary Gensler, and the UN Principles for Responsible Investment will join to discuss climate change and its effect on global financial markets. FASB Publishes Taxonomy Implementation Guide for CECL Disclosures and Note Style Guide
The Financial Accounting Standards Board (FASB) recently released a proposed XBRL Taxonomy Implementation Guide for Financing Receivable and Current Expected Loss (CECL) disclosures. This guide is based on and in accordance with the SEC Reporting Taxonomy and the US Generally Accepted Accounting Principles Financial Reporting (US GAAP) Taxonomy. The proposed Implementation Guide provides illustrations of disclosures concerning financing receivables pursuant to FASB Accounting Standards Codification, Topics 310, Receivables, and 326, Financing Instruments–Credit Losses. Elements for text blocks, policy text blocks, and table text blocks (Levels 1-3) are not included in the Guide. The publication places focus on detail tagging only (Level 4). {expires: 2021-07-27}

SEC Announces EDGAR Structured Disclosure API Is Available for Beta Testing
On July 2, 2021, the SEC announced that an API (Application Programming Interface) is now available for beta testing on data.sec.gov. In addition to XBRL data from financial statements (Forms 10-Q, 10-K, 8-K, 20-F, 40-F, 6-K, and their variants) in a JSON format, the API features entity information and submission history.

US and UK Regulatory Authorities Meet to Discuss Central Counterparty Resolution
On June 25, 2021, top officials from the SEC, the Commodity Futures Trading Commission (CFTC), the Federal Reserve Board, the Federal Deposit Insurance Corporation (FDIC), and the Bank of England assembled remotely to share points of view related to the concept of central counterparty (CCP) resolution. This cross-agency body of senior-level officials, which has been meeting regularly since 2017, also gathers to assess the progress of an ongoing program of joint endeavors among the agencies.

SEC Issues XBRL Taxonomy Update
Following its upgrade to Release 21.2, the EDGAR system began supporting the 2021 International Financial Reporting Standards (IFRS) Taxonomy. The 2021 IFRS Taxonomy is consistent with that of the International Accounting Standards Board which was made available on the its website on March 24, 2021.
