Image processing is based in part on the work of the Independent JPEG Group. The PDF processing is based in part on the work of Takeshi Kanno. Compression library zLib is incorporated “as is” and copyright 1995-2018 Jean-loup Gailly and Mark Adler.
Acceptance – By clicking “Accept”, you agree to the terms and conditions of this License. This License may be revised at the discretion of Novaworks in subsequent releases of the Software. If you have a separate manually executed License for the Software, that License supersedes this agreement.
Limited License – Permission is hereby granted, free of charge, to any person obtaining a copy of Software for non-commercial use such as individual, education or non-profit organization. You may reproduce and distribute the Software and Derivative Software provided that in all cases the Software is distributed: (i) without modification; (ii) free of charge to end-users; and (iii) with a copy of this Agreement. You agree to not remove or alter or bypass this notice, its click-through dialog or any other copyright notice within the Software.
Enterprise and commercial redistribution requires the purchase of a Redistribution/Enterprise License. Corporate, for-profit organizations, for-profit individuals may use the Software free of charge provided the use is not supporting commercial resale, system management or other commercial computing web or cloud operations.
Disclaimer and Exclusions – You acknowledge that the Software is provided on an “as is” basis and Novaworks makes no representations or warranties whatsoever, oral or written, express or implied, as to the accuracy or nature of the data from which the Software is compiled, the merchantability and fitness of the Software for your particular purpose nor the compatibility of the Software with your hardware and systems. Novaworks does not warrant that the Software will operate uninterrupted or error-free; nor does Novaworks make any warranty as to the results that may be obtained from your use of the Software or that the software will meet any of your requirements, will be timely, free of viruses or other harmful components, or operate in combination with any hardware, software system, or data.
Limitation of Damages – Under no circumstances shall Novaworks be liable hereunder for special, punitive, exemplary, indirect, incidental or consequential damages arising out of or related to this Agreement including, but not limited to lost profits, lost revenues, or loss of business, regardless of the form of action, whether in contract, tort, strict product liability, or otherwise even if Novaworks was advised in advance of the possibility of the damages in question and even if such damages were foreseeable; and even if your remedies fail of their essential purpose.
Liability – Novaworks shall have no liability under any provision of this Agreement with respect to any performance problem, claim of infringement or other matter to the extent attributable to any unauthorized or improper use or modification of the Software, or any unauthorized combination of the Software with other software or hardware. Under no circumstances shall Novaworks be liable for any action or damages arising from the use or distribution of your Derivative Software.
Governing Law and Jurisdiction – This Agreement shall be governed by the laws of the State of New York. Both parties agree that the exclusive venue for any proceeding or action between or among the parties shall lie in Monroe County, New York, and each party irrevocably waives any objection to such exclusive venue and to a trial by jury.
